Terms & Conditions

Last Updated: 14 April 2025  ·  Effective Date: 14 April 2025  ·  Permata Wira, Kuala Lumpur, Malaysia

Please read these Terms and Conditions carefully before using the website at permataw.site or engaging Permata Wira for any watch servicing. By submitting a service enquiry or entering into a service agreement with us, you confirm that you have read, understood, and accepted these terms.

1. Definitions

2. Acceptance of Terms

Use of this website or submission of a service enquiry constitutes acceptance of these terms. You must be at least 18 years of age to engage our services or submit personal data through this website. By engaging us, you confirm you have the legal capacity to enter into a binding agreement.

3. Service Description

Permata Wira provides three service pathways for mechanical timepieces:

Services are available to clients in Malaysia and to international clients visiting the atelier in Kuala Lumpur. We do not currently offer postal or courier intake.

4. Service Intake and Scope

All services begin with a written Intake Record produced by the attending watchmaker. This document records the current condition of the piece, the scope of work agreed, and the starting price range. No service work commences until the Intake Record has been reviewed and acknowledged by the client, either in person or via written communication.

If inspection of the movement or bracelet reveals additional work required beyond the agreed scope, Permata Wira will contact the client before proceeding. Additional work requires explicit client agreement. A client who does not wish to authorise additional work may request return of the piece in its current state; a partial charge reflecting work completed to that point may apply.

5. Client Responsibilities

6. Intellectual Property

All content on this website — including text, photography, layout, and design — is the property of Permata Wira or its licensors. You may not reproduce, distribute, or create derivative works from website content without prior written consent. The Permata Wira name and any associated marks are not to be used without our permission.

7. Payment Terms

All pricing is quoted and invoiced in Malaysian Ringgit (MYR). Starting prices for each service pathway are published on the website. The final invoice will reflect the agreed scope of work as confirmed after intake examination.

Refund and Cancellation

If a client wishes to cancel a service after intake but before work has commenced, the piece will be returned with no charge. If work has already begun, a charge reflecting the labour and materials consumed to that point will apply. Refunds are not available for completed services where the work was carried out in accordance with the agreed Intake Record. If you have concerns about a completed service, please contact us at [email protected] and we will investigate the matter.

8. Timelines

Timeline estimates provided at intake are indicative, not contractual commitments. The Standard Service Pathway typically takes 4–8 weeks; the Bracelet Refinishing Service 2–4 weeks; the Heritage Service Programme 12–18 weeks. If a service requires additional time beyond the initial estimate, the client will be notified and given the option to continue or collect the piece at the stage reached.

9. Disclaimers

Watch servicing outcomes depend on the condition and history of the piece at intake. Permata Wira does not make representations about rate accuracy beyond what is achievable for a given calibre and age. Vintage and heavily worn movements may not achieve the same performance as new calibres following service.

We are not responsible for pre-existing defects that were not identifiable at intake, or for faults that arise from the nature or age of the piece rather than the service carried out. The website is provided on an as-is basis; we make no warranties regarding uninterrupted access or the accuracy of all content.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Permata Wira's liability in connection with any service shall not exceed the amount paid for that specific service. We shall not be liable for indirect, consequential, or incidental losses arising from the service or the use of this website. Nothing in these terms limits our liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

11. Indemnification

You agree to indemnify and hold harmless Permata Wira and its employees from any claims, losses, or expenses (including legal costs) arising from your breach of these terms or from inaccurate information provided at intake.

12. Termination

Either party may withdraw from a service agreement before work commences. Once work has begun, withdrawal by the client is subject to the partial charge provisions in Section 7. Permata Wira reserves the right to decline or discontinue a service if the piece is found to present risks to the workshop or personnel that were not disclosed at intake.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising out of or in connection with a service or these terms shall first be addressed through direct negotiation. If not resolved within 30 days, the parties agree to submit to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

Clients may also have rights under the Consumer Protection Act 1999 (Malaysia), which these terms do not limit or exclude.

14. General Provisions

15. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will be published on this page with a revised "Last Updated" date. Continued use of the website or engagement of our services following a material change constitutes your acceptance of the updated terms.
